Defeat SENATE BILL 13-021 that gives oil & gas eminent domain in CO

The Colorado Legislature is working to pass SENATE BILL 13-021 that will give oil and gas companies rights of eminent domain over private and public property for usage of their pipelines, etc. If this goes through, none of the front range cities who have voted to ban fracking within city limits or any of our public lands will be safe from intrusive commercial oil and gas extraction. We want the legislature to vote against SENATE BILL 13-021.

The supreme court, section 38-5-105, CRS 2011, did not grant, “expressly or by clear implication, the power of eminent domain to companies for the purpose of constructing its pipeline.” Rather, the court said, the statute was intended to authorize condemnation for the purpose of constructing electric power infrastructure. Thus, the supreme court reversed and remanded the case to the district court for consideration of plaintiffs’ attorney’s fees. PLEASE KEEP IT THAT WAY. DO NOT LET THE OUR PRIVATE AND PUBLIC LANDS BE CONDEMNED BY THE OIL AND GAS COMPANIES!

Why is this important?

SENATE BILL 13-021 will give oil and gas companies rights of eminent domain over private and public property for usage of their commercial pipelines for fracking and other extraction without any public input whatsoever. If this goes through, none of the front range cities who have voted to ban fracking within city limits or any of our public lands will be safe from intrusive commercial oil and gas extraction. We want the legislature to vote against SENATE BILL 13-021
